EP PLUS GROUP will collect and use personal information in accordance with such laws (including the Personal Data Protection Act 2010), this Privacy Notice and the terms in your agreement(s) with any EP PLUS GROUP entity that you may have contracted with.

In order for EP PLUS and our subsidiaries to operate in an efficient and effective manner and provide you with the best service possible, we may collect personal information from you which may include but is not limited to contact information about you such as your name, address(es), telephone number(s), email address(es) and other contact information, profession and household income.

EP PLUS and/or its subsidiaries may collect personal information from you in one or more of the following methods:-

As a part of providing you with our services and/or products and the management and/or operation of the same, EP PLUS and/or its subsidiaries may be required or need to disclose information about you to the following third parties:

- companies and/or organisations that act as our agents, contractors, service providers and/or professional advisers
- companies and/or organisations that assist us in processing and/or otherwise fulfilling transactions that you have requested

We will otherwise treat your personal information as private and confidential and will not disclose your information to anyone outside EP PLUS except where:-
- you have given your consent,

- where required or authorised by any order of court, tribunal or authority, whether governmental or quasi-governmental with jurisdiction over EP PLUS;
- where we may transfer rights and obligations under our agreement(s) with you; and/or
- where we are required to meet our obligations to any relevant legal authority.
Direct Marketing
EP PLUS and/or its subsidiaries may use your personal information to provide you with information about our and third party services and/or products, which may be of interest to or benefit you, except where otherwise requested by you.
In certain instances, we may disclose your personal information to our preferred merchants and strategic partners. However, please note that we will only disclose your personal information to our merchants and strategic partners where your prior consent has been obtained and subject at all times to any laws (including regulations, guidelines and/or obligations) applicable to EP PLUS and its subsidiaries.
We take reasonable steps to ensure that our agreements with our merchants and/or strategic partners include appropriate privacy and confidentiality obligations.
If you do not wish your personal information to be utilised for the purposes of marketing or should you change your mind in relation to your previous decision, please contact us at the address detailed at the end of this Privacy Notice. Your latest written instructions to us will prevail.
What If Personal Information Provided By You Is Incomplete?
Where indicated (for example in application forms), it is obligatory to provide your personal information to us to enable us to process your application for our services and/or products. Should you decline to provide such obligatory personal information, we may not be able to process your application or provide you with our services or products.
Your Rights To Access And Correct Your Personal Information
We can assist you to access and correct your personal information held by us.
Where you wish to have access to your personal information in EP PLUS and/or its subsidiaries possession, or where you are of the opinion that such personal information held by us is inaccurate, incomplete, misleading or where relevant, not up-to-date, you may contact us at the contact details provided below. We will use reasonable efforts to comply with your request to access or correct your personal information within 21 days of receiving your request and the relevant processing fee.
Please note that EP PLUS and/or its subsidiaries may have to withhold access to your personal information in certain situations, for example when we are unable to confirm your identity or where information requested for is of a confidential commercial nature or in the event we receive repeated requests for the same information. Nevertheless, we will notify you of the reasons for not being able to accede to your request.

TERMS OF USE
1. Introduction
These Terms of Use (“Terms“) constitute a legally binding agreement between you and EP Plus Group Sdn. Bhd. (Company Registration No.: 199701014075 (429571-D)) (“EPP”) governing your use of the list of platforms operated by EPP and each of our respective related corporations (as the term is defined in the Companies Act 2016), affiliates, and associated companies (hereinafter referred to as “EPP“, “Company” “we” “our” or “us“) set out in paragraph 2 below (“Platforms”). By using any of the Platforms, you acknowledge and agree that you accept these Terms.
The use of these Terms should be read in tandem with:
a. our Privacy Policy, for which a copy of the same is available here. The Privacy Policy sets out how we deal and/or process any personal data you submit to us or which we collect from you; and
b. our Cookie Policy, for which a copy of the same is available here. The Cookie Policy sets out the cookies on the Platforms and how we use them.
The Privacy Policy and Cookie Policy are incorporated by reference into these Terms and together form and shall hereinafter referred to as the “Agreement“.
Your signing up and/or continued use of any of the Platforms constitute your acceptance of and agreement to all the terms and conditions set out in these Terms, Privacy Policy and Cookie Policy as well as any future amendments and additions to this Agreement that we may publish from time to time. If any changes to this Agreement are unacceptable to you or cause you to no longer be in compliance with this Agreement, you must immediately stop using any of the Platforms.

EPP has taken all reasonable care to ensure the information and facts contained on the Platforms are accurate and up-to-date when first posted. However, EPP does not undertake to update or correct such information. EPP does not make any representations or warranties, express or implied as to the accuracy or completeness of any information included on the Platforms. EPP reserves the right to change, delete or move any of the material on the Platforms at any time without notice in accordance with Clause 10 below.
Further, any information provided on this Platforms is intended for informational purposes only and is not intended as a substitute for professional medical advice, diagnosis, or treatment. The content, including but not limited to text, graphics, images, and other material contained on the Platforms, is for general informational purposes only. We do not recommend or endorse any specific tests, physicians, products, procedures, opinions or other information that may be mentioned on the Platforms. 4. User Responsibilities
Registration Information
To access the Platforms (where logging in is required), you must provide accurate and complete registration information, including their full name, email address, and any other relevant information as required by our company. Users agree to promptly update their registration details to ensure that they remain accurate and complete.
Verification or Registration
We reserve the right to review and verify each registration request before granting access to the Platforms. If a conflict of interest or any other reason is identified that could compromise the integrity of the Platforms or our business interests, we may, at our sole and absolute discretion, reject the registration without providing any notifications and/or explanations to the applicant.
User Responsibility for Account Security
You are solely responsible for maintaining the confidentiality of your login credentials and for any activity that occurs under your account. You agree to notify us immediately of any unauthorized use of their account or any other breach of security.
Right to Deny or Revoke Access
We reserve the right to deny or revoke access to the Platforms to any user, including healthcare professionals, at our sole discretion, if it has been determined, in our sole and absolute discretion, that there may be a conflict of interest or any other reason that could potentially compromise the integrity of the Log-in Portal or our business interests. We may exercise this right without prior notice and without providing any explanation to you.
Online Store Terms
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.
5. Intellectual Property Rights
All brand names, products and service names and titles used on the Platforms are trademarks and trade names of their respective owners. EPP claims no ownership in, nor any affiliation with, any third-party trademarks appearing on the Platforms unless explicitly stated. Such third-party trademarks are used only to identify the products and services of their respective owners, and no sponsorship or endorsement on the part of the EPP should be inferred from the use of these marks.
All other text, graphics, editorial content, data, formatting, graphs, designs, HTML, look and feel, photographs, music, sounds, images, software, videos, typefaces and other content, including EPP designs, trademarks, and logos (collectively “Proprietary Material”), that you see or read on the Platforms are owned by EPP. The Proprietary Material is protected in all forms, media and technologies now known or hereinafter developed. EPP owns all Proprietary Material, as well as the coordination, selection, arrangement and enhancement of such Proprietary Materials. The Proprietary Material is protected by domestic and international laws governing copyright, patents, and other proprietary rights. You may store, print and display any Proprietary Material solely for your own personal use, but are not permitted to publish, manipulate, distribute, or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on the Platforms nor may you use any such content in connection with any business or commercial enterprise.
6. Third-Party Links
The Platforms may contain certain hypertext links which will lead to other websites which are not under the control of EPP. When you activate any of these you will leave any of the Platforms, EPP has no control over and will accept no responsibility or liability (direct or indirect) for any damages or losses caused or alleged to be caused by or in connection with the use of or reliance on any content, products, services available on or through any such third-party websites.
When you leave any of the Platforms, we encourage you to read the terms and conditions and privacy policy of each third-party website that you visit. Your use of third-party websites is at your own risk, and you should take precautions to ensure that any link you select or software you download (whether from the Platforms or other websites) is free of viruses, worms, trojan horses, defects, and other items of a destructive nature.
EPP and its affiliates do not warrant that the Platforms are free from computer viruses, system failures, worms, trojan horses, or other harmful components or malfunctions, including during hyperlink to or from third-party websites. EPP and its affiliates will implement reasonable and appropriate technical and organizational measures to ensure a level of security adapted to the risk for any personal information supplied by you.
7. Modification to Service and Prices
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
8. Products or Services (if applicable)
Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. 9. Disclaimer of Warranties, Limitations on Liability and Indemnification

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE PROVIDE THE PLATFORMS ON AN “AS IS” WITHOUT WARRANTY OF ANY KIND AND WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING LIMITATION TO, WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. EPP MAKES NO WARRANTIES OR REPRESENTATIONS THAT: (A) THE PLATFORMS WILL MEET YOUR REQUIREMENTS; (B) THE PLATFORMS WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE CONTENT THAT MAY BE OBTAINED FROM THE USE OF THE PLATFORMS WILL BE ACCURATE OR RELIABLE; (D) THE QUALITY OF ANY GOODS OR SERVICES AVAILABLE ON THE PLATFORMS WILL MEET YOUR EXPECTATIONS; (E) ANY ERRORS ON THE PLATFORMS WILL BE CORRECTED; (F) THAT YOUR USE OF THE PLATFORMS OR ANY MATERIAL OBTAINED FROM THE PLATFORMS WILL NOT CAUSE ANY HARM OR DAMAGE, INCLUDING TO YOUR COMPUTER SYSTEM OR MOBILE DEVICE OR THAT NO LOSS OF DATA WILL RESULT FROM OBTAINING SUCH MATERIAL.
Limitations on Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER EPP (INCLUDING ITS AFFILIATES) WILL BE LIABLE FOR ANY CLAIMS, DEMANDS, DAMAGES, EXPENSES, LOSSES, GOVERNMENTAL OBLIGATIONS, SUITS, AND/OR CONTROVERSIES OF EVERY KIND AND NATURE, KNOWN AND UNKNOWN, SUSPECTED AND UNSUSPECTED, DISCLOSED AND UNDISCLOSED, DIRECT, INDIRECT, INCIDENTAL, ACTUAL, CONSEQUENTIAL, ECONOMIC, SPECIAL, OR EXEMPLARY, INCLUDING SOLICITORS’ FEES AND COSTS, INCLUDING LOSS OF DATA OR LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE OR SYSTEM FAILURE OR THE COST OF SUBSTITUTE PRODUCTS OR SERVICES, OR FOR ANY DAMAGES FOR PERSONAL OR BODILY INJURY OR EMOTIONAL DISTRESS ARISING OUT OF OR IN CONNECTION WITH: (A) THE AGREEMENT; AND (B) THE USE OF OR INABILITY TO USE THE PLATFORMS OR ANY CONTENT THEREIN.
Indemnity
YOU HEREBY AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS EPP AND ITS RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, SERVICE PROVIDERS, SUBCONTRACTORS, SUPPLIERS AND AFFILIATES FROM ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, JUDGMENTS, AWARDS, LOSSES AND/OR COSTS (INCLUDING WITHOUT LIMITATION TO PROFESSIONAL COSTS) INCURRED IN CONNECTION WITH (A) YOUR USE OR INABILITY TO USE THE PLATFORMS; (B) YOUR USE OF OR ANY RELIANCE ON ANY CONTENT ON THE PLATFORMS; (C) YOUR USE OF OR ANY RELIANCE OF ANY CONTENT ON ANY THIRD-PARTY WEBSITES LINKED TO FROM THE PLATFORMS (D) YOUR UNATHORISED USE OF, OR MISUSE OF, THE PLATFORMS; (E) YOUR VIOLATION OF ANY PORTION OF THE AGREEMENT, ANY LAW, OR THE RIGHTS OF ANY THIRD PARTY.
THIS CLAUSE (7) SHALL EXPRESSLY SURVIVE THE TERMINATION OF THE AGREEMENT.
10. Governing Law and Jurisdiction
The Agreement shall be interpreted and governed by the laws of Malaysia.
Any dispute, controversy or claim arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the competent court in Malaysia.
